RCMP Annual Report on the Ministerial Direction on Avoiding Complicity in Mistreatment by Foreign Entities

In September 2017, the Ministerial Direction (2017 MD) to the RCMP: Avoiding Complicity in Mistreatment by Foreign Entities came into effect, creating new and more stringent requirements to monitor and report on information sharing with foreign partners.

The 2017 MD required an annual report to the Minister regarding the application of this Direction, including:

  1. details about cases where the Direction was engaged, including the number of cases
  2. any restrictions on any arrangements due to concerns about potential mistreatment
  3. any changes to internal policies and procedures related to this Direction

More recently, on September 4, 2019, pursuant to subsection 3(1) of the Avoiding Complicity in Mistreatment by Foreign Entities Act (the Act), the Governor in Council, on the recommendation of the Minister of Public Safety Canada (PS), issued the Order in Council Directions for Avoiding Complicity in Mistreatment by Foreign Entities (the Directions) to the Commissioner of the RCMP.

In accordance with subsection 7(1) of the Act, the RCMP is required to produce an annual report to describe the activities the RCMP has undertaken to ensure compliance with the 2019 Order in Council Directions. Further, in subsection 7(2) of the Act, the RCMP, as soon as feasible, must make a version of their annual report available to the public.
